HLS 14RS-5944 ORIGINAL Page 1 of 2 Regular Session, 2014 HOUSE CONCURRENT RESOLUTI ON NO. 214 BY REPRESENTATIVE WHITNEY HEALTH CARE: Memorializes the United States Congress to repeal the Affordable Care Act A CONCURRENT RESOLUTI ON1 To memorialize the United States Congress to take such actions as are necessary to repeal2 the Affordable Care Act in its entirety.3 WHEREAS, the Affordable Care Act consists of the following Acts of Congress,4 collectively:5 (1) The Patient Protection and Affordable Care Act, which originated as H.R. 35906 in the One Hundred Eleventh United States Congress and became Public Law No. 111-148.7 (2) The Health Care and Education Reconciliation Act, which originated as H.R.8 4872 in the One Hundred Eleventh United States Congress and became Public Law No.9 111-152; and10 WHEREAS, serious problems with the Affordable Care Act, referred to hereafter as11 the "ACA", were evident from the time it was introduced as a bill, as illustrated in part by12 the statement of the speaker of the United States House of Representatives presiding at the13 time indicating that congress would have to pass the bill in order for the public to find out14 what is in it; and15 WHEREAS, every major aspect of the ACA has proven highly controversial and has16 caused deep divisions among leaders who seek to institute needed reforms in our nation's17 health care system; and18 WHEREAS, implementation of the ACA has been a greater challenge than the19 federal government can manage, as evidenced most notably by serious technical problems20 and delays associated with the rollout of the HealthCare.gov website that impeded21 HLS 14RS-5944 ORIGINAL HCR NO. 214 Page 2 of 2 enrollment in coverage by the very persons that the law required to do so, with problems1 persisting up to and including the final day by which persons were required to enroll or face2 a financial penalty; and3 WHEREAS, estimates cited by the current Speaker of the United States House of4 Representatives indicate that as a result of the ACA's mandates, the health insurance policies5 of between five million and six million Americans, the vast majority of whom are employed,6 have been canceled; and7 WHEREAS, the nonpartisan Congressional Budget Office estimates that the8 subsidies the ACA provides for health coverage will discourage Americans from working,9 and will cause approximately two million five hundred thousand employees to leave the10 labor force; and11 WHEREAS, other persons whom the ACA will negatively impact are our nation's12 senior citizens, as the law will cut over seven hundred billion dollars from Medicare over13 ten years and redirect those funds to finance an array of new entitlements mandated by the14 law; and15 WHEREAS, because the ACA has been a troubled law since the time it was enacted,16 fully repealing this law would be a responsible and prudent action by the present congress.17 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby18 memorialize the United States Congress to take such actions as are necessary to repeal the19 Affordable Care Act in its entirety.20 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the21 presiding officers of the Senate and the House of Representatives of the Congress of the22 United States of America and to each member of the Louisiana congressional delegation.23 DIGEST The digest printed below was prepared by House Legislative Services.
