HLS 14RS-520 ORIGINAL Page 1 of 2 Regular Session, 2014 HOUSE CONCURRENT RESOLUTI ON NO. 95 BY REPRESENTATIVE STUART BISHOP CONGRESS: Memorializes congress to expand the Americans with Disabilities Act to require arm chairs A CONCURRENT RESOLUTI ON1 To memorialize the United States Congress to take such actions as are necessary to require2 places of public accommodation and commercial facilities be equipped for persons3 who need assistance rising from the seated position.4 WHEREAS, Title III of the Americans with Disabilities Act of 1990 (42 U.S.C.5 12181) requires places of public accommodation and commercial facilities to be designed,6 constructed, and altered in compliance with the accessibility standards established by federal7 regulation; and8 WHEREAS, as our population ages and our veterans return home from overseas,9 there is a growing population who are unable to rise from the seated position without10 physical hands-on assistance from others, including strangers; and11 WHEREAS, the need to require assistance from others to complete the task of rising12 from a seated position robs persons of their independence and dignity; and13 WHEREAS, if seating accommodations were to be equipped with raised arms or14 parts from which a person could push when rising then this would eliminate the need for15 persons to obtain assistance from others.16 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby17 memorialize the United States Congress to amend the Americans with Disabilities Act of18 1990 (42 U.S.C. 12181) or to take such actions as are necessary to require that places of19 public accommodation and commercial facilities be equipped with seating for persons who20 are unable to rise from a seated position without assistance.21 HLS 14RS-520 ORIGINAL HCR NO. 95 Page 2 of 2 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the1 presiding officers of the Senate and the House of Representatives of the Congress of the2 United States of America and to each member of the Louisiana congressional delegation.3 DIGEST The digest printed below was prepared by House Legislative Services.
