HOUSE RESOLUTION NO. 161

PUBLIC SERVICE COMN: Requests the Public Service Commission to review the rules
and regulations relative to wreckers and towing services
A RESOLUTION1
To urge and request the Louisiana Public Service Commission to review the rules and2
regulations relative to wreckers and towing services to ensure wrecker and towing3
practices are fair and equitable and submit a report before March 1, 2015, to the4
House Committee on Commerce of its findings and of any proposed rules and5
regulations to be considered by the Louisiana Public Service Commission.6
WHEREAS, the Louisiana Public Service Commission (commission), pursuant to7
R.S. 45:180.1, has the power and authority necessary to supervise, govern, regulate, and8
control the business of the operation and use of wreckers and towing services, to designate9
classes and categories of such vehicles, to fix reasonable and just rates, fares, tolls, charges10
for storage services, or charges for the commodities furnished or services rendered by11
persons engaging in the operation and use of such vehicles; and12
WHEREAS, no person shall engage in the business of operating and using wreckers13
and towing services without first having obtained from the commission a wrecker license;14
and15
WHEREAS, R.S. 32:1736 provides that all fees charged by a tow truck operator for16
the nonconsensual towing of a vehicle from private property or parking areas shall be17
uniform and shall be set in accordance with rules and regulations adopted by the18

WHEREAS, there are towing and recovery charges, other towing, equipment, and1
manpower charges, storage charges, and fuel surcharges for the towing of vehicles and such2
charges create a financial hardship, especially for college students; and3
WHEREAS, the hours of operation of a wrecker and towing company's storage4
facility and a cash-only payment method create additional hardships for a person when his5
vehicle is towed; and6
WHEREAS, wreckers and towing services are regulated by the Louisiana Public7
Service Commission and such practices and rules and regulations need to be reviewed8
periodically and amended to ensure wrecker and towing services are fair and equitable.9
THEREFORE, BE IT RESOLVED that the House of Representatives of the10
Legislature of Louisiana does hereby urge and request the Louisiana Public Service11
Commission to review the rules and regulations relative to wreckers and towing services to12
ensure that the practices are fair and equitable and submit a report before March 1, 2015, to13
the House Committee on Commerce of its findings and of any proposed rules and regulations14
to be considered by the Louisiana Public Service Commission.15
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the16
Louisiana Public Service Commission.17
