AN ACT1
To amend and reenact R.S. 17:3123.1(B) and (C), relative to the commissioner of higher2
education; to delete the requirement that the commissioner of higher education be3
confirmed by the Senate; to delete the requirement that the salary of the4
commissioner of higher education be approved by the Joint Legislative Committee5
on the Budget; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 17:3123.1(B) and (C) are hereby amended and reenacted to read as8
follows:9
ยง3123.1. Commissioner of higher education; appointment; qualifications; powers,10
duties and functions; compensation11

B. The commissioner of higher education shall be appointed by a two-thirds13
vote of the total membership of the Board of Regents and shall be subject to14
confirmation by the Senate.15
C. The salary of the commissioner of higher education shall be determined16
by the Board of Regents, subject to the approval of the Joint Legislative Committee17 SB NO. 108

on the Budget.1
Section 2. This Act shall become effective upon signature by the governor or, if not2
signed by the governor, upon expiration of the time for bills to become law without signature3
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If4
vetoed by the governor and subsequently approved by the legislature, this Act shall become5
effective on the day following such approval.6

Appel (SB 108)
Present law provides that the Board of Regents shall appoint a commissioner of higher
education to administer and implement board programs and policies. Further provides that
the commissioner shall possess such qualifications and have such other powers, functions,
duties, and responsibilities as established by the board or as provided by law.
Proposed law retains these provisions.
Present law provides that the commissioner of higher education shall be appointed by a two-
thirds vote of the total membership of the board and shall be subject to confirmation by the
Senate. 
Proposed law deletes the requirement that the commissioner of higher education be
confirmed by the Senate.
Present law provides that the salary of the commissioner of higher education shall be
determined by the board, subject to the approval of the Joint Legislative Committee on the
Budget (JLCB).
Proposed law deletes the requirement that JLCB approve the salary of the commissioner of
higher education.
Effective upon signature of the governor or lapse of time for gubernatorial action.
