BY SENATOR NEVERS 
TUITION. Constitutional Amendment to authorize the postsecondary education
management boards to establish tuition and mandatory fee amounts charged by institutions
under their supervision and management. (2/3-CA13sl(A))
A JOINT RESOLUTION1
Proposing to add Article VIII, Section 7.2 of the Constitution of Louisiana, relative to2
postsecondary education; to authorize public postsecondary management boards to3
establish the tuition and mandatory fee amounts charged by the institutions under4
their supervision and management; and to specify an election for submission of the5
proposition to electors and provide a ballot proposition.6
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members7
elected to each house concurring, that there shall be submitted to the electors of the state, for8
their approval or rejection in the manner provided by law, a proposal to add Article VIII,9
Section 7.2 of the Constitution of Louisiana, to read as follows:10
ยง7.2.  Postsecondary Education Management Boards; Tuition and Fee Authority11
Section 7.2. Notwithstanding the provisions of Article VII, Section12
(2.1)(A), or any other provision of this constitution or law to the contrary, any13
postsecondary education management board created by this Article shall have14
the authority to establish the tuition and mandatory fee amounts charged by the15
institutions under its supervision and management.16

to the electors of the state of Louisiana at the statewide election to be held on November 4,1
2014.2
Section 3. Be it further resolved that on the official ballot to be used at said election3
there shall be printed a proposition, upon which the electors of the state shall be permitted4
to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as5
follows:6
Do you support an amendment to authorize the postsecondary education7
management boards to establish the tuition and mandatory fee amounts8
charged by the institutions under their supervision and management, without9
legislative approval?10

Present constitution (Art. VII, Sec. 2.1(A)) provides that any new fee or civil fine or increase
in an existing fee or civil fine imposed or assessed by the state or any board, department, or
agency of the state shall require the enactment of a law by a two-thirds vote of the elected
members of each house of the legislature.
Proposed constitutional amendment provides that, notwithstanding this provision and any
other constitutional provision or law to the contrary, the constitutionally created
postsecondary education management boards have the authority to establish the tuition and
fee amounts charged by the institutions under their supervision and management, without
legislative approval.
Specifies submission of the amendment to the voters at the statewide election to be held on
November 4, 2014.
