AN ACT1
To amend and reenact R.S. 27:416(C), relative to video poker; to provide relative to diesel2
fuel sale requirements at qualified truck stops; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 27:416(C) is hereby amended and reenacted to read as follows:5
ยง416. Qualified truck stop facilities; number of devices; fuel sales6

C. Except as provided in R.S. 27:421, the number of video draw poker8
devices placed at a qualified truck stop facility shall be based on the average monthly9
fuel sales calculated quarterly, using four sets of three calendar months, for the first10
year of operation and thereafter shall be based upon the average monthly fuel sales11
calculated annually, using a calendar year, as follows:12
(1) One hundred thousand gallons of fuel of which forty thousand gallons are13
diesel - not more than fifty devices.14
(2) Seventy-five thousand gallons of fuel of which thirty thousand gallons are15
diesel - not more than forty devices.16

Morrell (SB 130)
Present law provides for the number of video draw poker devices placed at a qualified truck
stop facility to be based on the average monthly fuel sales, which sales require a minimum
of number of gallons to be diesel fuel sales.
Proposed law retains present law as to the number of video draw poker devices that may be
placed at a qualified truck stop facility to be based on the average monthly fuel sales, but
removes the diesel fuel sale requirements.
Effective August 1, 2014.
