Morrell (SB 133)
Present law prohibits any person under the age of 21 years to enter or be permitted to enter, the
designated gaming area of a riverboat, the official gaming establishment, or the designated slot
machine gaming area of a pari-mutuel wagering facility which offers live horse racing licensed
for operation and regulated by the Gaming Control Board.
Proposed law retains present law but provides an exception for emergency responders under the
age of 21 who are acting in their official capacity to enter such area.
Present law provides that any person who has or controls directly or indirectly five percent or
more ownership, income, or profit or economic interest in an entity which has or applies for a
license or permit or enters into a casino operating contract with the state pursuant to the
provisions of this Title, or who receives five percent or more revenue interest in the form of a
commission, finder's fee, loan repayment, or any other business expense related to the gaming
operation, or who has the ability, in the opinion of the board, to exercise a significant influence
over a licensee, the casino gaming operator, a permittee, or other person required to be found
suitable pursuant to the provisions of law, is also required to meet all suitability requirements and
qualifications pursuant to the provisions of law.
Proposed law retains present law and requires any person who also has the capacity to exercise a
significant influence over a licensee, the casino gaming operator, or a permittee, is also required
to meet all suitability requirements and qualifications.
Proposed law provides that in determining whether a person has significant influence, the board
or division may consider but is not limited to the following: management and decision making
authority; operational control; financial relationship; receipt of gaming revenue or proceeds;
financial indebtedness; and gaming related associations.
Effective August 1, 2014.
