Regular Session, 2014 SENATE BILL NO. 170 BY SENATOR LONG WILDLIFE/FISHERIES DEPT. Provides relative to the release of certain game, fowl, or fish. (8/1/14) AN ACT1 To amend and reenact R.S. 56:20, relative to the release of certain game, fowl, or fish; to2 provide for the liberation of pen-raised or wild animal, fowl, or fish; to provide for3 the release of pen-raised turkeys and pheasants; to allow certain persons to take4 escaped or released pen-raised white-tailed deer and pen-raised or nonnative exotic5 cervid deer; to require certain biological testing; to provide terms, conditions, and6 requirements; and to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 56:20 is hereby amended and reenacted to read as follows: 9 ยง20. Releasing game, fowl, or fish; permission; intrastate restocking; violations 10 A. No pen-raised or wild animal, fowl, or fish of any species from within or11 without the state shall be liberated within the state except upon written permission12 of the secretary. No pen-raised turkey or pheasant from within or without the state13 shall be liberated within the state except upon written permission of the secretary.14 B. C. (1) Any person licensed to take deer in this state, authorized1 department personnel, or officer authorized to enforce the provisions of R.S.2 56:112 may take escaped or released pen-raised white-tailed deer during the3 regular open deer season.4 (2) Any person licensed to take deer in this state, authorized department5 personnel, or officer authorized to enforce the provisions of R.S. 56:112 may6 take escaped or released pen-raised or nonnative exotic cervid deer species,7 including but not limited to axis deer, fallow deer, sika deer, red deer, and elk,8 year-round during daylight hours.9 (3) The department shall be notified immediately upon the taking of any10 white-tailed deer or cervid deer and the carcass shall be submitted to the11 department for biological testing before being returned to the person.12 D. Violations of the provisions of this Section shall constitute a class four13 violation, as provided in R.S. 56:34.14 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by McHenry Lee. DIGEST Long (SB 170) Present law prohibits the in state release of any pen-raised or wild animal, fowl, or fish from without the state except upon permission of the secretary of DWF. Proposed law prohibits the in state release of any pen-raised or wild animal, fowl, or fish from within the state except upon permission of the secretary of DWF. Present law prohibits the in state release of any pen-raised turkey or pheasant from within or without the state except upon permission of the secretary of DWF. Proposed law removes present law. Present law prohibits the transportation of any wild animal or fowl for restocking purposes except in accordance with the commission rules. Proposed law adds fish to the list of animals prohibited from transporting for restocking purposes. Proposed law allows certain individuals to take escaped or released pen-raised white-tailed deer during regular open deer season and to take escaped or released pen-raised or nonnative cervid deer species during daylight hours year-round. Further provides that the department must be notified immediately upon the taking of the animal and the carcass will be submitted for biological testing before being returned to the person.
