Proposed law requires that, notwithstanding any provision of law or any rule, regulation, or
policy to the contrary, the governing authority of each public elementary and secondary school
adopt a policy authorizing a school nurse to carry and administer inhalers, as defined in present
law, to a student who the school nurse, in good faith, professionally believes is having a
symptom of wheezing, whether or not such student has a prescription for an inhaler. The school
nurse may administer the inhaler to respond to a student's symptom of wheezing, under standing
protocol from a physician licensed to practice medicine in the state.
