AN ACT1
To amend and reenact R.S. 26:351(2)(a), (3), and (4) and to enact R.S. 26:351(9) and (10),2
relative to containers for beverages of high alcoholic content; to require certain3
container sizes for certain alcoholic beverages sold or shipped in the state; to provide4
relative to the number of containers in each shipping case or container; to exempt5
certain products; to prohibit the sale and shipment into this state of any containers of6
powdered alcohol; and to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 26:351(2)(a), (3), and (4) are hereby amended and reenacted and R.S.9
26:351(9) and (10) are hereby enacted to read as follows: 10
ยง351. Limitation on size of containers of beverages of high alcoholic content;11
standards of fill12
Except for wines, no manufacturer or wholesaler in this state shall have in his13
possession any beverages of high alcoholic content outside of his bonded stockroom14
unless they are in containers of no greater capacity than 1.75 liters.  The standards15
of fill shall be the following:16

(2)(a) All wine, sold in or shipped into this state shall be in the following18
containers: twenty liters, nineteen and five-tenths liters, eighteen liters, seventeen19
liters, sixteen liters, fifteen liters, fourteen liters, thirteen liters, twelve liters, eleven20
liters, ten liters, nine liters, eight liters, seven liters, six liters, five liters, four liters,21
three liters, one and five-tenths liters, one liter, seven hundred fifty milliliters, five22
hundred milliliters, three hundred seventy-five milliliters, three hundred fifty-five23
milliliters, one hundred eighty-seven milliliters.24 SB NO. 204	ENROLLED

"(3)(a) Distilled spirits, whether domestically bottled or imported, subject to2
the metric standard of fill prescribed in Paragraph (1) above shall be packed with the3
following number of bottles containers per shipping case or container:4

(b) For purposes of this Paragraph, "container" shall mean any13
receptacle produced and manufactured with any substance used to package14
distilled spirits for delivery to the public.15
(4)(a) Wines bottled subject to the standards of fill prescribed in Paragraph16
(2) above of this Subsection shall be packed with the following number of bottles17
containers per shipping case or shipping container:18

produced and manufactured with any substance used to package wine for delivery1
to the public.2

(9) The container restrictions provided for in this Section shall not apply4
to cider products.5
(10) No container sold in or shipped into this state shall include6
powdered alcohol.7
Section 2. This Act shall become effective upon signature by the governor8
or, if not signed by the governor, upon expiration of the time for bills to become law9
without signature by the governor, as provided by Article III, Section 18 of the10
Constitution of Louisiana. If vetoed by the governor and subsequently approved by11
the legislature, this Act shall become effective on the day following such approval.12
