BY SENATORS RISER AND MORRELL 
DISTRICT ATTORNEYS. Provides for the omnibus new assistant district attorney
positions for various judicial districts in the state. (8/1/14)
AN ACT1
To amend and reenact R.S. 16:51(A)(5), (6), (7), (14), (16), (19), (20), (21), (24), (29), (36),2
and (37), relative to assistant district attorneys; to provide for additional assistant3
district attorneys for certain judicial districts; to provide for an effective date; and to4
provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 16:51(A)(5), (6), (7), (14), (16), (19), (20), (21), (24), (29), (36), and7
(37) are hereby amended and reenacted to read as follows:8
ยง51.  Assistant district attorneys9
A. The district attorney of each judicial district and of the parish of Orleans10
shall appoint a first assistant district attorney and such other assistant district11
attorneys for his respective judicial district or for the parish of Orleans as may be12
necessary, the total number of assistant district attorneys in each judicial district and13
in the parish of Orleans to be not less than as hereinafter set forth:14

(5) In the Fifth Judicial District, six seven assistant district attorneys;16

Section 2. Notwithstanding the provisions of R.S. 16:11 to the contrary, the25
provisions of Section 1 of this Act shall become operative if, and only if, Section 1 of this26
Act is funded from the amount of State General Fund (Direct) or State General Fund by27
Statutory Dedications contained in House Bill No. 1 of the 2014 Regular Session as received28
in the Senate on May 12, 2014, or if the source of funding for Section 1 is from local or other29 SB NO. 214

sources to be used to fund such additional assistant district attorney positions.1

Proposed law increases the number of assistant district attorneys in particular judicial

contained in HB No.1 of the 2014 Regular Session as received in the Senate or if the source
of funding is from local or other sources.
Effective August 1, 2014.

1. Deletes effectiveness provisions provided that funding is provided for the
additional 22 assistant district attorney positions in the general appropriations
bill.
2. Notwithstanding the provisions of law relative to assistant district attorney
salaries, the provisions paying for the additional positions shall become
operative if, and only if, such salaries are funded from the amount of State
General Fund or Statutory Dedications contained in HB No.1 of the 2014
Regular Session as received in the Senate or if the source of funding is from
local or other sources.
