Murray (SB 227)
Present law provides that original jurisdiction for workers' compensation claims shall be the
office of workers' compensation, within the Louisiana Workforce Commission.
Proposed law repeals present law and provides that original jurisdiction for workers'
compensation claims shall be the district courts.
Present law provides that if at any time after notification to the office of the occurrence of death
or injury resulting in excess of seven days lost time, a bona fide dispute occurs, the employee or
his dependent or the employer or insurer may file a claim with the office of workers'
compensation where the hearing will be held on a form to be provided by the director of the
office of workers' compensation.
Proposed law provides that beginning January 1, 2015, if a death or injury which lasts longer
than seven work days and a bona fide dispute occurs, the employee or his dependent or the
employer or insurer may file a claim with the district court so long as the accident or injury
occurred on or after January 1, 2015.
Present law provides workers' compensation judges, employed by the office of workers'
compensation, shall adjudicate workers' compensation claims.
Proposed law repeals present law and provides that district court judges shall adjudicate workers'
compensation claims.
Effective January 1, 2015.
