Regular Session, 2014 SENATE BILL NO. 234 BY SENATOR JOHN SMITH COURTS. Provides for remission to Indigent Defender Fund of certain court costs in mayor's court of the Town of New Llano. (gov sig) AN ACT1 To amend and reenact R.S. 33:448(D), relative to mayor's courts; to provide relative to court2 costs for municipal ordinance violations in the mayor's court of the town of New3 Llano; to provide for the remission of certain funds; and to provide for related4 matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 33:448(D) is hereby amended and reenacted to read as follows:7 ยง448. Mayor's court; town of New Llano; establishment; jurisdiction; additional8 court costs9 * * *10 D. Section 2. This Act shall become effective upon signature by the governor1 or, if not signed by the governor, upon expiration of the time for bills to become law2 without signature by the governor, as provided by Article III, Section 18 of the3 Constitution of Louisiana. If vetoed by the governor and subsequently approved by4 the legislature, this Act shall become effective on the day following such approval.5 The original instrument was prepared by Angela Lockett De Jean. DIGEST John Smith (SB 234) Present law provides that in addition to the court costs authorized by present law, the mayor of the town of New Llano, as the presiding officer of the mayor's court of the town of New Llano, may impose additional court costs not to exceed $20 for each offense, as defined by ordinance, on any defendant convicted of a violation of a municipal ordinance. Proposed law increases the additional court cost not to exceed $40 for each offense and provides that $10 dollars of any additional court costs collected pursuant to present law shall be remitted to the 30 th Judicial District's Indigent Defender's Fund. Effective upon signature of the governor or lapse of time for gubernatorial action.
