CRIME/PUNISHMENT.  Provides for a five year minimum sentence for home invasions.

AN ACT1
To amend and reenact R.S. 14:62.8(B)(1) and (2), relative to the crime of home invasion;2
to provide a minimum sentence of five years imprisonment at hard labor for home3
invasion; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 14:62.8(B)(1) and (2) are hereby amended and reenacted to read as6
follows: 7

B.(1) Except as provided in Paragraphs (2) and (3) of this Subsection,10
whoever commits the crime of home invasion shall be fined not more than five11
thousand dollars and shall be imprisoned at hard labor for not less than five years12
nor more than twenty-five years.13
(2) Whoever commits the crime of home invasion while armed with a14
dangerous weapon shall be fined not more than seven thousand dollars and shall be15
imprisoned at hard labor for not less than five years nor more than thirty years.16

Section 2. This Act shall become effective upon signature by the governor or, if not1
signed by the governor, upon expiration of the time for bills to become law without signature2
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If3
vetoed by the governor and subsequently approved by the legislature, this Act shall become4
effective on the day following such approval.5

Present law defines and provides penalties for the crime of home invasion.
Present law provides that whoever commits the crime of home invasion is to be fined up to
$5,000 and imprisoned at hard labor for up to 25 years, unless the offender is armed with a
dangerous weapon, in which case he is to be fined up to $7,000 and imprisoned at hard labor
for up to 30 years.
Proposed law retains present law and adds that whoever commits the crime of home
invasion, whether or not armed with a dangerous weapon, is to be imprisoned for a minimum
of five years and up to the maximum number of years provided by 	present law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
