CRIME/PUNISHMENT.  Provides for a five year minimum sentence for home invasions.

AN ACT1
To amend and reenact R.S. 14:62.8(B)(2), relative to the crime of home invasion; to provide2
a minimum sentence of five years imprisonment at hard labor for home invasion; and3
to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 14:62.8(B)(2) is hereby amended and reenacted to read as follows:6

(2) Whoever commits the crime of home invasion while armed with a10
dangerous weapon shall be fined not more than seven thousand dollars and shall be11
imprisoned at hard labor for not less than five years nor more than thirty years.12

Section 2. This Act shall become effective upon signature by the governor or, if not14
signed by the governor, upon expiration of the time for bills to become law without signature15
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If16
vetoed by the governor and subsequently approved by the legislature, this Act shall become17 SB NO. 313

effective on the day following such approval.1

Present law defines and provides penalties for the crime of home invasion.
Present law provides that whoever commits the crime of home invasion armed with a
dangerous weapon is to be fined up to $7,000 and imprisoned at hard labor for up to 30
years.
Proposed law retains present law and adds that whoever commits the crime of home invasion
armed with a dangerous weapon is to be imprisoned for a minimum of five years.  Proposed
law otherwise retains present law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
