Clement, Jr. DIGEST White (SB 313) Present law defines and provides penalties for the crime of home invasion. Present law provides that whoever commits the crime of home invasion is to be fined up to $5,000 and imprisoned at hard labor for up to 25 years, unless the offender is armed with a dangerous weapon, in which case he is to be fined up to $7,000 and imprisoned at hard labor for up to 30 years. Proposed law retains present law and adds that whoever commits the crime of home invasion, whether or not armed with a dangerous weapon, is to be imprisoned for a minimum of five years and up to the maximum number of years provided by present law. Effective upon signature of the governor or lapse of time for gubernatorial action. (Amends R.S. 14:62.8(B)(1) and (2))
