LAW ENFORCEMENT.  Requires certain law enforcement agencies to establish procedures
that prohibit checkpoints where the only vehicles subject to inspection are motorcycles.

AN ACT1
To enact R.S. 32:295.4(5), relative to motor vehicle checkpoints; to require certain law2
enforcement agencies to establish procedures that prohibit checkpoints where the3
only vehicles subject to or targeted for inspection are motorcycles; and to provide for4
related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 32:295.4(5) is hereby enacted to read as follows: 7
ยง295.4. Guidelines for seat belt and motor vehicle liability security checkpoints;8
law enforcement agencies9
All law enforcement agencies involved in traffic enforcement shall establish10
guidelines for the operation of seat belt checkpoints and proof of compulsory motor11
vehicle liability security checkpoints. Such guidelines shall include but not be12
limited to the following provisions:13

(5) Provisions prohibiting the establishment of checkpoints where the15
only vehicles subject to or targeted for inspection are motorcycles, as defined16
in R.S. 32:1(38).17 SB NO. 317

Present law requires law enforcement agencies to establish guidelines for the operation of
seat belt checkpoints and proof of compulsory motor vehicle liability insurance checkpoints.
Proposed law retains present law and requires law enforcement agencies to establish
guidelines prohibiting the establishment of checkpoints where the only vehicles subject to
or targeted for inspection are motorcycles, as defined by law.
Effective August 1, 2014.
