UNEMPLOYMENT COMP. Provides relative to reciprocal agreements with federal and
state agencies. (8/1/14)
AN ACT1
To amend and reenact R.S. 23:1665(A)(4), relative to unemployment compensation; to2
provide for credit to employers for contributions paid to another state or federal3
unemployment compensation fund; to remove the administrative discretion with4
regard to award of such credit; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 23:1665 is hereby amended and reenacted to read as follows:7
ยง1665.  Reciprocal arrangements with federal and state agencies8
A. The administrator may enter into reciprocal arrangements with appropriate9
and duly authorized agencies of other states or of the United States, or both,10
whereby:11

(4) For the purposes of R.S. 23:1543 through 1551, contributions due under13
this Chapter with respect to wages for insured work shall be deemed to have been14
paid to the fund as of the date payment was made as contributions therefor under15
another state or federal unemployment compensation law, provided that proof of16
the contribution is provided to the administrator; but no such arrangement shall17 SB NO. 377

be entered into unless it contains provisions for the reimbursement of such the1
contributions and the actual earnings thereon, as the administrator finds will be fair2
and reasonable as to all affected interests.3
Reimbursements paid from the fund pursuant to Paragraph (3) of this4
Subsection shall be deemed to be benefits for the purpose of Parts II and V of this5
Chapter. The administrator may make to other state or federal agencies and receive6
from them, reimbursements from or to the fund, in accordance with arrangements7
entered into pursuant to the provisions of this Section.8

Present law provides that the administrator (executive director of the La. Workforce
Commission) will decisions regarding delinquent payments made in accordance with other
state or federal unemployment laws in accordance with what the administrator deems fair
and reasonable.
Proposed law relieves the administrator of any discretion and requires that payments to other
state or federal funds will be considered.
Effective August 1, 2014.
