ALCOHOLIC BEVERAGES. Provides with respect to operating without a permit. (8/1/14)
AN ACT1
To amend and reenact R.S. 26:75(C) and 275(B), relative to permits for engaging in the2
business of manufacturing, supplying, or dealing in alcoholic beverages; to allow for3
sampling under a special event permit; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 26:75(C) and 275(B) are hereby amended and reenacted to read as6
follows:7
§75.  Operation without permit prohibited8

C.(1) Notwithstanding any law to the contrary, beer, wine, or other spirit10
sampling for the purpose of allowing a consumer to try the taste of a product may be11
conducted on the premises of a Class A, or Class B, or a Special Event permit12
holder.13
(2)  The commissioner shall promulgate rules and regulations for the14
conducting of spirit beverage alcohol sampling, which shall allow manufacturers15
and wholesalers to provide and display a limited amount of point of sales materials.16

B.(1) Notwithstanding any law to the contrary, beer, wine, or other spirit3
sampling for the purpose of allowing a consumer to try the taste of a product may be4
conducted on the premises of a Class A, or Class B, or a Special Event permit5
holder.6
(2) The commissioner shall promulgate rules and regulations for the7
conducting of spirit beverage alcohol sampling, which shall allow manufacturers8
and wholesalers to provide and display a limited amount of point of sales materials.9

Present law provides that beer, wine, or other spirit sampling for the purpose of allowing a
consumer to try the taste of a product may be conducted on the premises of a Class A or
Class B permit holder.
Proposed law retains present law and further authorizes Special Event permit holders to
provide beer, wine, or other spirit sampling to consumers.
Present law provides that the commissioner shall promulgate rules and regulations for the
conducting of spirit sampling, which shall allow manufacturers and wholesalers to provide
and display a limited amount of point of sales materials.
Proposed law makes a technical change to present law by using the defined term "beverage
alcohol" instead of "spirit".
Effective August 1, 2014.
