Regular Session, 2014 ENROLLED SENATE BILL NO. 387 BY SENATOR LAFLEUR AN ACT1 To enact Part XVI of Chapter 2 of Title 33 of the Louisiana Revised Statutes of 1950, to be2 comprised of R.S. 33:1420.21, relative to special districts; to provide relative to the3 actions of the governing authority of certain such districts; to provide relative to the4 approval of such actions; to provide for an effective date; and to provide for related5 matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. Part XVI of Chapter 2 of Title 33 of the Louisiana Revised Statutes of8 1950, to be comprised of R.S. 33:1420.21 is hereby enacted to read as follows:9 PART XVI. SPECIAL DISTRICTS-MISCELLANEOUS PROVISIONS10 ยง1420.21. Special districts; approval of actions by local governmental11 subdivision12 A. If the governing authority of a local governmental subdivision is also13 the governing authority of a special district that the local governmental14 subdivision created pursuant to state law or the local governmental15 subdivision's home rule charter and action of the governing authority of the16 special district requires approval of the governing authority of the local17 governmental subdivision, the action of the governing authority of the special18 district and the approval by the local governmental subdivision may occur in19 one meeting of the governing authority of the local governmental subdivision.20 B. The provisions of this Section shall apply only when the members of21 the governing authority of the local governmental subdivision and of the special22 district are identical in number and in name.23 C. Notwithstanding the provisions of this Section, the governing24 authority of the local governmental subdivision and the governing authority of25 the special district shall independently follow any notice requirements26 applicable to any actions taken by such entity.27 SB NO. 387 ENROLLED Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. D. As used in this Part, "local governmental subdivision" means a1 parish or municipality.2 Section 2. This Act shall become effective upon signature by the governor or, if not3 signed by the governor, upon expiration of the time for bills to become law without signature4 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
