AN ACT1
To amend and reenact R.S. 38:90.1(1) and (10), relative to the statewide flood-control2
program; to define certain terms; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1. R.S. 38:90.1(1) and (10) are hereby amended and reenacted to read as5
follows: 6
ยง90.1.  Definitions7
As used in this Chapter, unless the context clearly indicates otherwise, the8
following terms shall have the meanings ascribed to them as follows:9
(1) "Authority" means a parish or municipality, or both, authorized by law10
to perform governmental functions and any special district created for the purpose11
of drainage and/or flood control.12

(10) "Project" means a program or engineering activity, either new or14
continuing, exclusive of modifications to drainage structures located within state15
highway rights -of-way right-of-way, that will be planned and implemented with the16
primary goal being the reduction of existing flood damages.17 SB NO. 391

Present law, relative to the statewide flood-control program, defines "authority" as a parish
or municipality, or both, authorized by law to perform governmental functions and any
special district created for the purpose of drainage and/or flood control.
Also defines "project" as a program or engineering activity, either new or continuing,
exclusive of modifications to drainage structures located within state highway right-of-way,
that will be planned and implemented with the primary goal being the reduction of existing
flood damages.
Proposed law makes technical corrections.  Otherwise retains present law.
Effective August 1, 2014.
(Amends R.S. 38:90.1(1) and (10))
