SENATE BILL NO. 403
BY SENATOR MILLS 
HEALTH/ACC INSURANCE. Provides relative to third party payments of health insurance
premiums of individuals with HIV/AIDS. (8/1/14)
AN ACT1
To enact R.S. 22:1080, relative to third party premium payments; to provide with respect to2
insurers acceptance of third party premium payments; to require acceptance of3
premium payments from a fund or grant established by an office, agency, or political4
subdivision of a state, federal, parochial, or municipal governmental entity; and to5
provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 22:1080 is hereby enacted to read as follows:8
ยง1080.  Third party premium payments; refusal of acceptance9
No health insurance issuer or health maintenance organization shall10
refuse the receipt of a premium payment when such payment is made by a third11
party to the insurance contract, provided that the payment is made from or12
pursuant to a fund or grant established by any office, agency, or political13
subdivision of a state, federal, parochial, or municipal governmental entity.14
This Section shall not be construed to require a health insurance issuer or15
health maintenance organization to accept a third party premium payment16

Proposed law prohibits a health insurance issuer or health maintenance organization from
refusing to accept premium payments when such payment is made by a third party to the
insurance contract, provided that the payment is made from or pursuant to a fund or grant
established by any office, agency, or political subdivision of a state, federal, parochial, or
municipal governmental entity.
Effective August 1, 2014.
