MEDICAID. Provides for prohibitions within a Medicaid managed care program. (8/1/14)
AN ACT1
To enact Part XIV of Chapter 3 of Title 46 of the Louisiana Revised Statutes of 1950, to be2
comprised of R.S. 46:460.81, relative to Medicaid managed care program; to provide3
for certain prohibitions; to provide definitions; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. Part XIV of Chapter 3 of Title 46 of the Louisiana Revised Statutes of6
1950, comprised of R.S. 46:460.81, is hereby enacted to read as follows:7
PART XIV. PROHIBITIONS8
ยง460.81.  Prohibited advertising; definition9
For purposes of a Medicaid managed care program contracted for on or10
after January 1, 2015, the Department of Health and Hospitals shall include in11
the contracts for such Medicaid managed care program the prohibition of12
emergency room wait time advertising by a hospital, as defined in R.S. 40:2102,13
that is participating in a Medicaid managed care program. For the purposes of14
this Section, advertising means any sign, display, light, device, figure, painting,15
message, plaque, poster, billboard, or other thing that is designed, intended, or16
used to advertise or inform.17 SB NO. 493

Proposed law provides the Department of Health and Hospitals, for a Medicaid managed
care program contracted for on or after January 1, 2015, shall include in the contracts for
such Medicaid managed care program the prohibition of emergency room wait time
advertising by a hospital, as defined in present law, that is participating in a Medicaid
managed care program.
Proposed law defines advertising to mean any sign, display, light, device, figure, painting,
message, plaque, poster, billboard, or other thing that is designed, intended, or used to
advertise or inform.
Effective August 1, 2014.
