(gov sig) AN ACT1 To enact R.S. 37:1287.2, relative to a physician's license; to provide for the automatic2 suspension of a physician's license; to provide for a hearing; to provide for an3 effective date; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 37:1287.2 is hereby enacted to read as follows:6 ยง1287.2. Automatic suspension of a license7 A. Any license or permit issued by the board to a physician shall be8 automatically suspended upon a physician's conviction or entry of a plea of9 guilty or nolo contendere to a felony that constitutes a crime of violence as10 defined in R.S. 14:2, arises out of the practice of medicine, or arises out of the11 billing for health care services.12 B.(1) The automatic suspension provided for in this Section shall remain13 in effect from the date of conviction or plea until the conclusion of the14 administrative proceedings and issuance of a final decision, consent order or15 other order by the board pursuant to the Administrative Procedure Act.16 (2) An individual whose license has been automatically suspended may17 SB NO. 505 SLS 14RS-242 ORIGINAL Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. request an expedited hearing before the board. The hearing required in1 Paragraph A(1) of this Section shall begin no later than ninety days from the2 date of the board's receipt of such request.3 Section 2. This Act shall become effective upon signature by the governor or, if not4 signed by the governor, upon expiration of the time for bills to become law without signature5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Proposed law provides the automatic suspension shall remain in effect from the date of conviction or plea until the conclusion of the administrative proceedings and issuance of a final decision, consent order or other order by the board pursuant to the Administrative Procedure Act. Proposed law provides an individual whose license has been automatically suspended may request an expedited hearing before the board.
