AN ACT1
To amend and reenact R.S. 37:753(E) and (I) and 786(A)(1) and (C), relative to the practice2
of dentistry and the regulation of the profession; to provide for the domicile of the3
Louisiana State Board of Dentistry; to provide for terms of board members; to4
provide for judicial review of adjudication; to provide for an effective date; and to5
provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 37:753(E) and (I) and 786(A)(1) and (C) are hereby amended and8
reenacted to read as follows:9
§753. Louisiana State Board of Dentistry; appointment of members; term of office;10
vacancies; nominating meetings; quorum; domicile11

E.(1)(a) Each person appointed to the board shall serve a term of five years.13
Any board member serving on August 15, 1993, shall thereafter be appointed for no14
more than two consecutive five-year terms. 15
(b) On or after August 15, 1993, no person shall be appointed to serve more16
than two consecutive five-year terms. Regardless of a board member's dates of17
service, including past service, no person shall serve more than a total of ten18

consecutive or not.1
(c) The provisions of Subparagraph (b) of this Paragraph shall not2
prevent a board member serving on August 1, 2014, from completing his term3
of service, but shall thereafter apply.4

I. The domicile of the Louisiana State Board of Dentistry shall be the city of6
New Orleans parish of East Baton Rouge.7

§786.  Judicial review of adjudication9
A.(1) Where the board, whether through a disciplinary committee or the10
entire board, renders a decision in an administrative adjudication, the party aggrieved11
by it may resort to the civil district court for the parish of Orleans Nineteenth12
Judicial District in the parish of East Baton Rouge for judicial review. Any such13
appeals shall be filed in the court in the same manner as original suits are instituted14
therein. A preliminary, procedural, or intermediate agency action or ruling is15
immediately reviewable if review of the final agency decision would not provide an16
adequate remedy and would inflict irreparable injury.17

C. All proceedings in the civil district court for the parish of Orleans19
Nineteenth Judicial District in the parish of East Baton Rouge and appellate20
courts arising under this Section are civil in nature and shall be heard summarily by21
the court without a jury, shall take precedence over other civil cases, and shall be22
tried in chambers or in open court, in and out of term.23

Section 2.  The provisions of R.S. 37:753(I) and 786(A)(1) and (C) as amended by25
Section 1 of this Act shall become effective January 1, 2017.26
Section 3. Except as provided in Section 2 of this Act, this Act shall become27
effective upon signature by the governor or, if not signed by the governor, upon expiration28
of the time for bills to become law without signature by the governor, as provided by Article29

approved by the legislature, this Act shall become effective on the day following such1
approval.2
