Proposed law provides any contract or agreement between a managed care organization and a health care provider shall include provisions that provide for the reimbursement of a health care provider in any instance in which the managed care organization requests or requires substitution of a medication for an enrollee. Proposed law does not apply to generic substitution or step therapy programs utilized by the managed care organization that promote generic drugs as a first-line therapy. Effective January 1, 2015. (Amends R.S. 22:1007(I); adds R.S. 22:1007(J)) Summary of Amendments Adopted by House Committee Amendments Proposed by House Committee on Insurance to the engrossed bill. 1. Clarified that the provisions of proposed law shall not apply to generic substitution or step therapy programs utilized by the managed care organization that promote generic drugs as a first-line therapy. 2. Provided an effective date of January 1, 2015. 3. Made technical changes.
