SENATE BILL NO. 596

MOTOR VEHICLES. Provides relative to required documentation for the issuance of
drivers' licenses and special identification cards.  (8/1/14)
AN ACT1
To amend and reenact R.S. 32:410(A)(3)(a)(ii) and (viii) and R.S. 40:1321(A), relative to2
drivers' licenses and special identification cards; to provide relative to the documents3
required for issuance of drivers' licenses and special identification cards; and to4
provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 32:410(A)(3)(a)(ii) and (viii) are hereby amended and reenacted to7
read as follows:8
§410. Form of license; photograph, signature of licensee, anatomical gift statement,9
declaration of life-sustaining procedures, and additional information10

(3)(a) Every license issued shall bear thereon:14

(ii) The applicant's full legal name, excluding the applicant's social16

be defined in compliance with the Real ID Act, if implemented. If and until such1
time as the Real ID Act is implemented, the applicant's full legal name shall be2
defined as the given name or names that appear on an official birth certificate3
together with the surname as it appears on the official birth certificate, unless the4
surname is changed in accordance with R.S. 9:292. No other name shall be permitted5
to be used unless the applicant provides proof of name change granted by a district6
court in accordance with the law. Should the Real ID Act be implemented, the full7
legal name shall be defined as stated by the Real ID Act. The department shall8
promulgate rules and regulations as are necessary to implement the provisions of this9
Item.10

(viii) Other information to identify the applicant including of birth (month,12
day, and year), sex, height, weight, and eye and hair color.  An applicant's license13
may bear his social security number at his option.14

Section 2. R.S. 40:1321(A) is hereby amended and reenacted to read as follows:16
§1321. Special identification cards; issuance; veteran designation; "I'm a Cajun"17
designation; fees; expiration and renewal; exceptions; promulgation18
of rules; promotion of use; persons less than twenty-one years of age;19
the Protect and Save our Children Program; Selective Service20
Registration21
A. Any Louisiana resident may obtain a special identification card from the22
office of motor vehicles within the Department of Public Safety and Corrections,23
hereinafter referred to as "OMV". The identifying information and documents of24
identification required, including any alternative means to ensure that the25
applicant meets the requirements of certification developed by OMV, to obtain26
a special identification card shall be the same as those required to obtain a Louisiana27
driver's license, as stated in R.S. 32:409.1. However, if the applicant is seventeen28
years of age, the signature of the custodial parent or guardian shall not be required,29 SB NO. 596

provided the applicant has the necessary identifying information and documents.1

Perry (SB 596)
Present law requires a driver's license to bear the applicant's full legal name.
Present law (R.S. 32:410(A)(3)(a)(viii)) provides that an applicant's driver's license may bear
his social security number at his option.
Proposed law provides that a driver's license shall not bear the applicant's social security
number.
Present law provides that the identifying information and documents of identification
required to obtain a special identification card are the same as those required to obtain a
Louisiana driver's license, as provided in R.S. 32:409.1.
Proposed law adds that identifying information and documents of identification includes any
alternative means to ensure that the applicant meets the requirements of certification
developed by OMV.
Effective August 1, 2014.
