BY SENATOR MORRELL 
FEES/LICENSES/PERMITS.  Requires the issuance of certain alcoholic beverage permits
to commercial film theaters. (7/1/14)
AN ACT1
To amend and reenact R.S. 26:71.1(1)(e) and 271.2(1)(e), relative to liquor permits; to2
provide relative to the issuance of certain alcoholic beverage permits to bona fide3
commercial film theaters under certain conditions; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 26:71.1(1)(e) and 271.2(1)(e) are hereby amended and reenacted to6
read as follows:7
§71.1. Class A permit; definitions8
The commissioner shall issue the following four types of Class A retail liquor9
permits:10
(1) Class A-General:11

(e) Notwithstanding the provisions of Subparagraphs (a) through (d) of this13
Paragraph, the commissioner may shall not issue a Class A - General liquor permit14
to any bona fide commercial film theater which had a Class A liquor permit on15
January 1, 1994 unless the bona fide commercial film theater complies with the16
requirements in R.S. 26:73(C)(1)(a), (b), and (c) and alcoholic beverage sales are17 SB NO. 654

physically segregated from all other concession sales and no one under the age1
of eighteen is allowed to enter the area where such alcoholic beverage sales are2
conducted.3

§271.2. Class A permit; definitions5
The commissioner shall issue the following four types of Class A retail6
permits for beverages of low alcoholic content:7
(1) Class A-General:8

(e) Notwithstanding the provisions of Subparagraphs (a) through (d) of this10
Paragraph the commissioner may shall not issue a Class A-General retail permit for11
beverages of low alcoholic content to a bona fide commercial film theater which had12
a retailers, Class A permit for beverages of low alcoholic content on January 1, 199413
unless the bona fide commercial film theater complies with the requirements in14
R.S. 26:272(C)(1)(a), (b), and (c) and alcoholic beverage sales are physically15
segregated from all other concession sales and no one under the age of eighteen16
is allowed to enter the area where such alcoholic beverage sales are conducted.17

Section 2. This Act shall become effective on July 1, 2014.; if vetoed by the19
governor and subsequently approved by the legislature, this Act shall become effective on20
July 1, 2014., or on the day following such approval by the legislature, whichever is later.21

Present law authorizes the commissioner of alcohol and tobacco control to issue a Class A-
General liquor permit to any bona fide commercial film theater which had a Class A liquor
permit on January 1, 1994.
Proposed law prohibits the commissioner of alcohol and tobacco control from issuing a
Class A- General liquor permit to any bona fide commercial film theater unless:
(1)Alcoholic beverage sales are physically segregated from all other concession sales. SB NO. 654

Summary of Amendments Adopted by Senate
Committee Amendments Proposed by Senate Committee on Judiciary B to the
original bill
1. Changes from requiring the commissioner to issue the permit in certain
instances to prohibiting the commission from issuing the permit unless
certain conditions are met.
2. Adds requirement that no one under the age of 18 be allowed to enter the
area where the alcoholic beverages sales are conducted.
