BY SENATORS MORRELL, BUFFI NGTON AND PEACOCK 
PUBLIC HEALTH. Provides relative to the minimum disinfectant residual levels of free
or total chlorine throughout public and private water systems. (8/1/14)
AN ACT1
To enact R.S. 40:4.15, relative to public water systems; to provide with respect to certain2
disinfectant levels; to provide for exemptions; to provide for an annual report; and3
to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 40:4.15 is hereby enacted to read as follows: 6
ยง4.15. Minimum disinfectant residual level of free or total chlorine throughout7
public water systems; rules and regulations; reporting8
A. The Department of Health and Hospitals, office of public health, shall9
promulgate rules and regulations pursuant to the Administrative Procedure Act10
that require a public water system to maintain a minimum disinfectant level of11
at least 0.1 parts per million of free or total chlorine in the water being delivered12
to the distribution system, in finished water storage tanks, and in all points of13
the distribution. This Section shall apply to any water system that provides14
water for residential consumption and use.15
B. The department shall review such rules and regulations as necessary16
and shall submit an annual report as to the state of public water systems across17 SB NO. 75

Louisiana to the Senate Committee on Health and Welfare and the House1
Committee on Health and Welfare no later than February first of each year.2
C. An industrial user or consumer that owns, operates, and maintains a3
water system dedicated to the exclusive use of its operations shall be exempt4
from any requirement to maintain a minimum disinfectant level of free or total5
chlorine in its water system.6

Proposed law provides the Department of Health and Hospitals, office of public health, shall
