FORESTRY.  Provides relative to the sale of certain forest tree seedlings. (gov sig)
AN ACT1
To amend and reenact R.S. 3:4303, relative to the sale of certain forest tree seedlings; to2
provide relative to retention of sale receipts; to provide relative to department3
nurseries; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 3:4303 is hereby amended and reenacted to read as follows:6
ยง4303. Forest tree seedlings; change of price; sale to those engaged in forestry7
activities8
The commission from time to time may fix by appropriate rules and9
regulations the prices at which forest tree seedlings grown at its department10
nurseries shall be sold to landowners engaged in forestry activities, which price shall,11
insofar as possible, be conducive to the promotion and development of sound12
reforestation practices in this state and all receipts from the sale of seedlings shall be13
retained by the commission department and expended in the development and14
operation of the commission's department's nurseries for scientific forestry research15
and experimentation for land acquisition and general operations of the commission16

Section 2. This Act shall become effective upon signature by the governor or, if not1
signed by the governor, upon expiration of the time for bills to become law without signature2
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If3
vetoed by the governor and subsequently approved by the legislature, this Act shall become4
effective on the day following such approval.5

Present law requires the La. Forestry Commission to retain all receipts from the sale of
seedlings at commission nurseries. 
Proposed law instead requires the Dept. of Agriculture and Forestry to retain all receipts
from the sale of seedlings at department nurseries.
Present law requires that receipts from the sale of seedlings be expended in the development
and operation of the commission's nurseries for scientific forestry research and
experimentation for land acquisition and general operations of the commission.
Proposed law narrows the scope of present law to require that receipts from the sale of
seedlings only be expended in the general operations of the department nurseries instead of
the commission and otherwise retains present law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
