Requests the Department of Environmental Quality to give extra consideration to the views of the local officials and the surrounding community when deciding to issue certain landfill permits. A CONCURRENT RESOLUTI ON1 To urge and request the Department of Environmental Quality to give extra consideration2 to the views of the local officials and the surrounding community when deciding to3 issue certain landfill permits.4 WHEREAS, the Department of Environmental Quality is constitutionally and5 statutorily charged with the protection of the environment of Louisiana; and6 WHEREAS, local governments are chiefly responsible for parish land use7 determinations and zoning ordinances in order to effectively maximize its resources and8 navigate its future development both in economic terms and management of the quality of9 life of its citizens; and10 WHEREAS, currently under the Louisiana Administrative Code, Title 33, Part VII,11 the Department of Environmental Quality, within its industrial waste disposal permitting12 process, is unable to consider changes in local land use restrictions and zoning ordinances13 by local governments and their economic development requirements after an application has14 been submitted to the department; and15 WHEREAS, it is important that the Department of Environmental Quality has the16 authority to consider permittee compliance with local zoning and land use restrictions prior17 to issuance of an order to commence operations of a waste disposal facility.18 SCR NO. 159 SLS 14RS-4606 ORIGINAL Page 2 of 2 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby1 urge and request the Department of Environmental Quality to give extra consideration to the2 views of the local officials and the surrounding community when deciding to issue certain3 landfill permits.4 BE IT FURTHER RESOLVED that the Department of Environmental Quality shall5 immediately take all necessary steps to initiate through its rule-making authority all6 measures to incorporate such local requirements into its industrial waste regulations under7 Title 33 of the Louisiana Administrative Code.8 BE IT FURTHER RESOLVED that prior to the department issuing an order to9 commence operations, any industrial waste disposal facility permittee, except for any10 transfer station, shall provide the department with a written resolution or authorization from11 the appropriate municipal or parish governing authority where the facility will be located,12 dated within one hundred eighty days prior to such order and stating that the facility is in13 compliance with all existing local zoning and land use restrictions.14 BE IT FURTHER RESOLVED that the department shall immediately take all15 necessary steps to implement such requirements into all industrial waste disposal permits16 which have not yet received an order to commence from the department.17 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the18 secretary of the Department of Environmental Quality.19 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Heyward Jeffers.
