SENATE RESOLUTION NO. 205
BY SENATOR BROWN 
WORKERS' COMPENSATION.  Requests the Department of Insurance to study the
particular job classifications by the National Council on Compensation Insurance as relates
to skilled and nonskilled employees in the home and community based industry.
A RESOLUTION1
To urge and request the Department of Insurance to review the workers' compensation2
classifications of certain skilled and nonskilled employees in the home and3
community based industry by the National Council on Compensation Insurance.4
WHEREAS, the National Council on Compensation Insurance (NCCI) gathers data,5
analyzes industry trends, and prepares objective insurance rates and loss cost6
recommendations to the various state departments of insurance who subscribe to this service7
and to the workers' compensation providers which is used in determining their workers'8
compensation rates; and9
WHEREAS, the home and community based health industry provides much needed10
care utilizing both skilled and nonskilled employees; and11
WHEREAS, significant differences in the activities and responsibilities of skilled and12
nonskilled employees is reflected in the job expectations and compensation of these13
individuals; and14
WHEREAS, the workers' compensation rating by NCCI places these skilled and15
nonskilled employees in the same workers' classification and should reflect the differences16
in job expectations, responsibilities, and compensation; and17
WHEREAS, the Department of Insurance may suggest modifications of the18 SR NO. 205

determinations by NCCI as applied in the state of Louisiana; and1
WHEREAS, the Department of Insurance should review NCCI classifications as to2
skilled and nonskilled employees in the home and community based industry in Louisiana3
and make such recommendations as to the workers' compensation rates as will adequately4
reflect the differences in the respective job expectations, responsibilities, and compensation.5
THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana6
does hereby request the Department of Insurance to review NCCI classifications as to skilled7
and nonskilled employees in the home and community based industry in Louisiana and make8
such recommendations to NCCI for adjustment in rates as will adequately reflect the9
differences in the respective job expectations, responsibilities, and compensation.10
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to11
commissioner of the Department of Insurance.12
