Page 1 of 2 Regular Session, 2014 ENROLLED SENATE RESOLUTION NO. 205 BY SENATOR BROWN A RESOLUTION To urge and request the Department of Labor to review the workers' compensation classifications of certain skilled and nonskilled employees in the home and community based industry by the National Council on Compensation Insurance. WHEREAS, the National Council on Compensation Insurance (NCCI) gathers data, analyzes industry trends, and prepares objective insurance rates and loss cost recommendations to the various state departments of insurance who subscribe to this service and to the workers' compensation providers which is used in determining their workers' compensation rates; and WHEREAS, the home and community based health industry provides much needed care utilizing both skilled and nonskilled employees; and WHEREAS, significant differences in the activities and responsibilities of skilled and nonskilled employees is reflected in the job expectations and compensation of these individuals; and WHEREAS, the workers' compensation rating by NCCI places these skilled and nonskilled employees in the same workers' classification and should reflect the differences in job expectations, responsibilities, and compensation; and WHEREAS, the Department of Labor may suggest modifications of the determinations by NCCI as applied in the state of Louisiana; and WHEREAS, the Department of Labor should review NCCI classifications as to skilled and nonskilled employees in the home and community based industry in Louisiana and make such recommendations as to the workers' compensation rates as will adequately reflect the differences in the respective job expectations, responsibilities, and compensation. SR NO. 205 ENROLLED Page 2 of 2 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana does hereby request the Department of Labor to review NCCI classifications as to skilled and nonskilled employees in the home and community based industry in Louisiana and make such recommendations to NCCI for adjustment in rates as will adequately reflect the differences in the respective job expectations, responsibilities, and compensation. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to commissioner of the Department of Labor. PRESIDENT OF THE SENATE
