HLS 15RS-188 ENGROSSED 2015 Regular Session HOUSE BILL NO. 109 BY REPRESENTATIVE RICHARD DISTRICTS/FIRE PROTECT: Provides relative to parcel fees levied by Fire Protection District 8-C in Lafourche Parish 1 AN ACT 2To amend and reenact R.S. 40:1505(D), relative to parcel fees levied by Fire Protection 3 District 8-C in Lafourche Parish; to provide relative to the definition of parcel; to 4 provide for responsibility for payment of the fee; and to provide for related matters. 5 Notice of intention to introduce this Act has been published 6 as provided by Article III, Section 13 of the Constitution of 7 Louisiana. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 40:1505(D) is hereby amended and reenacted to read as follows: 10 ยง1505. Parcel fee; submission to voters 11 * * * 12 D.(1) A "parcel" as used in this Section shall mean a lot, a subdivided 13 portion of ground or an individual tract upon which is located, either in whole or in 14 part, a residential or commercial structure, regardless of the structure's being 15 occupied or unoccupied. 16 (2)(a) Notwithstanding the provisions of Paragraph (1) of this Subsection, 17 within Fire Protection District 8-C in Lafourche Parish, the term parcel shall also 18 mean each improved portion of ground upon which a residential or commercial 19 structure has been or may be situated and to which a mailing address has been 20 assigned by a local governmental subdivision, a landowner, or a lessor. 21 (b) In the case of mobile home parks or other commercial property where 22 spaces are leased for residential or commercial structures, the landowner is Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 15RS-188 ENGROSSED HB NO. 109 1 responsible for the parcel fee for each portion of ground described in Subparagraph 2 (a) of this Paragraph. 3 (c) No parcel fee shall be levied on any parcel defined in this Paragraph 4 unless the question of levying such fee has been approved by a majority of the 5 registered voters of the district who vote on the proposition at an election held for 6 that purpose in accordance with the Louisiana Election Code. Present law provides for the creation of fire protection districts. Provides for their powers and duties and authorizes the levy of certain taxes and fees to support each district. Present law provides for the levy of a parcel fee, not to exceed $100, within each district. Present law further defines "parcel" for purposes of the fire protection district parcel fee to mean a lot or portion of ground upon which a residential or commercial structure is located, regardless of whether or not such structure is occupied. Proposed law retains present law. Proposed law provides that for Fire Protection District 8-C in Lafourche Parish, "parcel" also means each improved portion of ground upon which a residential or commercial structure has been or may be situated and to which a mailing address has been assigned by a parish or a municipality, a landowner, or a lessor. Proposed law further provides that in the case of mobile home parks or other commercial property where spaces are leased for residential or commercial structures, the landowner is responsible for the parcel fee. Proposed law requires voter approval of the levying of a parcel fee on any parcel as defined in proposed law. Further requires that any such parcel fee be imposed by resolution or ordinance of the governing authority of the district.
