HLS 15RS-650 REENGROSSED 2015 Regular Session HOUSE BILL NO. 159 BY REPRESENTATIVES HOFFMANN, BURRELL, CHANEY, HUNTER, JACKSON, LEBAS, JAY MORRIS, PONTI, AND SHADOIN AND SENATORS KOSTELKA, MILLS, RISER, THOMPSON, AND WALSWORTH PHARMACISTS: Adds a fee at license renewal for pharmacists and pharmacies and dedicates proceeds to certain pharmacy education programs 1 AN ACT 2To amend and reenact R.S. 37:1184(introductory paragraph), (2)(a), and (3)(a), 1207(A), 3 and 1230(A), relative to fees of the Louisiana Board of Pharmacy; to establish the 4 pharmacy education support fee to be collected by the board; to provide for 5 assessment of the fee at the time of pharmacist license renewal and pharmacy permit 6 renewal; to provide an option for pharmacists and pharmacies to elect not to remit 7 the fee; to dedicate the proceeds of the fee to certain public university pharmacy 8 schools; to provide for disbursement of the proceeds of the fee; and to provide for 9 related matters. 10Be it enacted by the Legislature of Louisiana: 11 Section 1. R.S. 37:1184(introductory paragraph), (2)(a), and (3)(a), 1207(A), and 121230(A) are hereby amended and reenacted to read as follows: 13 §1184. Renewal of license, registration, and certification; expiration; reinstatement 12 A.(1) Each person licensed, registered, or certified by the board shall apply 13 for renewal annually at a time designated by the board and pay a fee specified by the 14 board. A person who desires to continue in the practice of pharmacy or assist in the 15 practice of pharmacy in this state shall file with the board an application in such form 16 and containing such data as the board may require, and complete such other 17 requirements as deemed necessary by the board, for renewal. 18 (2)(a)(i) The board shall assess on each annual pharmacist license renewal 19 as required by this Section an additional fee of one hundred dollars to be designated 20 as the "pharmacy education support fee". This fee shall be dedicated and allocated 21 as specified in this Paragraph to an accredited school of pharmacy of a public 22 university in this state. The board shall include on each license renewal form issued 23 to a pharmacist an optional election whereby the person may elect not to remit the 24 one hundred dollar pharmacy education support fee. 25 (ii) For purposes of this Paragraph, "accredited" shall mean possession of 26 current accreditation from the Accreditation Council for Pharmacy Education. 27 (b) The board shall disburse all monies collected pursuant to this Paragraph 28 to an accredited public university pharmacy school in this state on or before April 29 first annually. HLS 15RS-650 REENGROSSED HB NO. 159 1 solely for the benefit of its pharmacy education program and the expenditure of such 2 funds shall be approved by the board of supervisors of the university system of 3 which the university is a member. The funds collected pursuant to this Paragraph 4 shall be in addition to any other monies received by the university that operates the 5 pharmacy school and are intended to supplement and not replace, displace, or 6 supplant any other funds that the university receives from the state or from any other 7 source. 8 * * * 9 §1230. Renewal of permits; expiration; reinstatement 10 A.(1) Each pharmacy issued a permit by the board shall apply for renewal 11 annually, at the time designated by the board and pay a fee specified by the board. 12 (2)(a)(i) The board shall assess on each annual pharmacy permit renewal 13 required by this Section an additional fee of one hundred dollars per year to be 14 designated as the "pharmacy education support fee". Proposed law provides that, in addition to any other fee authorized by present law, the Louisiana Board of Pharmacy (board) shall assess a fee of $100 on annual renewals of pharmacist licenses and pharmacy permits. Provides that the additional $100 fee be designated as the "pharmacy education support fee". Requires the board to include on each license or permit renewal form issued to a pharmacist or pharmacy an optional election whereby the person or pharmacy may elect not to remit this additional fee. Proposed law provides that all proceeds of the fee shall be dedicated and allocated to an accredited school of pharmacy of a public university in this state. Requires the board to disburse all monies collected pursuant to proposed law to the public university pharmacy school on or before April 1 annually. Proposed law requires that the university receiving the proceeds of the fee utilize the monies solely for the benefit of its pharmacy education program. Provides that the expenditure of such funds shall be approved by the board of supervisors of the university system of which the university is a member. Proposed law stipulates that the funds collected pursuant to proposed law shall be in addition to any other monies received by the university that operates the pharmacy school; and that such funds are intended to supplement and not replace, displace, or supplant any other funds that the university receives from the state or from any other source.
