1	AN ACT
2 To amend and reenact R.S. 37:1184(introductory paragraph), (2)(a), and (3)(a), 1207(A),
3 and 1230(A), relative to fees of the Louisiana Board of Pharmacy; to establish the
4 pharmacy education support fee to be collected by the board; to provide for
5 assessment of the fee at the time of pharmacist license renewal and pharmacy permit
6 renewal; to provide an option for pharmacists and pharmacies to elect not to remit
7 the fee; to dedicate the proceeds of the fee to certain public university pharmacy
8 schools; to provide for disbursement of the proceeds of the fee; and to provide for
9 related matters.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 37:1184(introductory paragraph), (2)(a), and (3)(a), 1207(A), and
12 1230(A) are hereby amended and reenacted to read as follows: 
13 §1184.  Fees
14	Notwithstanding any other provision of this Chapter, the fees and costs
15 established by the board in accordance with R.S. 37:1182(A)(19) R.S. 37:1182(A)
16 shall not be less than the following schedule:

8 §1207.  Renewal of license, registration, and certification; expiration; reinstatement
9	A.(1)  Each person licensed, registered, or certified by the board shall apply
10 for renewal annually at a time designated by the board and pay a fee specified by the
11 board.  A person who desires to continue in the practice of pharmacy or assist in the
12 practice of pharmacy in this state shall file with the board an application in such form
13 and containing such data as the board may require, and complete such other
14 requirements as deemed necessary by the board, for renewal.
15	(2)(a)(i)  The board shall assess on each annual pharmacist license renewal
16 as required by this Section an additional fee of one hundred dollars to be designated
17 as the "pharmacy education support fee".  This fee shall be dedicated and allocated
18 as specified in this Paragraph to an accredited school of pharmacy of a public
19 university in this state.  The board shall include on each license renewal form issued
20 to a pharmacist an optional election whereby the person may elect not to remit the
21 one hundred dollar pharmacy education support fee.
22	(ii)  For purposes of this Paragraph, "accredited" shall mean possession of
23 current accreditation from the Accreditation Council for Pharmacy Education.
24	(b)  The board shall disburse all monies collected pursuant to this Paragraph
25 to an accredited public university pharmacy school in this state on or before April
26 first annually. The public university pharmacy school shall utilize these monies
27 solely for the benefit of its pharmacy education program and the expenditure of such

1 funds shall be approved by the board of supervisors of the university system of
2 which the university is a member.  The funds collected pursuant to this Paragraph
3 shall be in addition to any other monies received by the university that operates the
4 pharmacy school and are intended to supplement and not replace, displace, or
5 supplant any other funds that the university receives from the state or from any other
6 source.

8 §1230.  Renewal of permits; expiration; reinstatement
9	A.(1)  Each pharmacy issued a permit by the board shall apply for renewal
10 annually, at the time designated by the board and pay a fee specified by the board.
11	(2)(a)(i)  The board shall assess on each annual pharmacy permit renewal
12 required by this Section an additional fee of one hundred dollars per year to be
13 designated as the "pharmacy education support fee".  This fee shall be dedicated and
14 allocated as specified in this Paragraph to an accredited school of pharmacy of a
15 public university in this state.  The board shall include on each permit renewal form
16 issued to a pharmacy an optional election whereby the pharmacy may elect not to
17 remit the one hundred dollar pharmacy education support fee.
