LEVEES/BDS & DISTRICTS: To provide for the transfer of certain property from the
Atchafalaya Basin Levee District to the Terrebonne Levee and Conservation District
in Terrebonne Parish
1 AN ACT
2To amend and reenact R.S. 38:291(U)(1), relative to the Terrebonne Levee and
3 Conservation District; to provide for the transfer of certain land in the possession of
4 the Atchafalaya Basin Levee District for certain purposes to the Terrebonne Levee
5 and Conservation District; and to provide for related matters.
6 Notice of intention to introduce this Act has been published
7 as provided by Article III, Section 13 of the Constitution of
8 Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 38:291(U)(1) is hereby amended and reenacted to read as follows:
11 ยง291. Naming; limits of districts; composition of boards

13 U. Terrebonne Levee and Conservation District. (1) On July 1, 1997, and
14 continuing thereafter, all lands in the parish of Terrebonne shall constitute a levee
15 district to be known as the Terrebonne Levee and Conservation District. These lands
16 and all property thereon situated, not exempt from taxation, shall be subject to the
17 provisions of this Chapter. The land, including mineral rights, in the possession of
18 the Atchafalaya Basin Levee District in Terrebonne Parish, for the purposes of
19 ownership and maintenance and operation of the Atchafalaya Basin Levee District,

1 shall be transferred and conveyed to the Terrebonne Levee and Conservation District
2 without the necessity of any other act or instrument of grant, transfer, conveyance,
3 or delivery. For the purpose of proving evidence of the transfer, conveyance, and
4 delivery effected by this Paragraph, the Atchafalaya Basin Levee District shall
5 execute an act setting forth the transfer, conveyance, and delivery of those lands,
6 rights-of-way, servitudes, and revenues therefrom to the Terrebonne Levee and
7 Conservation District.

9 Section 2. This Act shall become effective upon signature by the governor or, if not
10signed by the governor, upon expiration of the time for bills to become law without signature
11by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
12vetoed by the governor and subsequently approved by the legislature, this Act shall become
13effective on the day following such approval.

Abstract: Requires the Atchafalaya Basin Levee District execute an act evidencing the
transfer of property to the Terrebonne Levee and Conservation District.
Present law provides that all land, including mineral rights, in the possession of the
Atchafalaya Basin Levee District in Terrebonne Parish for the purposes of ownership and
maintenance and operation of the Atchafalaya Basin Levee District be transferred to the
Terrebonne Levee and Conservation District.
Proposed law retains present law and requires the Atchafalaya Basin Levee District execute
an act evidencing the transfer provided for in present law.
Effective upon signature of governor or lapse of time for gubernatorial action.
