PROPERTY/PUBLIC:  Authorizes the transfer of certain state property located in Union
Parish
1	AN ACT
2To authorize and provide for the transfer of certain state property; to authorize the transfer
3 of certain state property in Union Parish; to provide for the property description; to
4 provide for reservation of mineral rights; to provide terms and conditions; to provide
5 an effective date; and to provide for related matters
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  The secretary of the Department of Transportation and Development,
8notwithstanding any other provision of law to the contrary, is hereby authorized and
9empowered to convey, transfer, assign, lease, or deliver any interest, excluding mineral
10rights, the state may have to all or any portion of the following described parcel of property
11to the governing authority of the Town of Marion in Union Parish, Louisiana:
12	Legal Description
13 A certain piece or portion of ground, together with all buildings and improvements
14 thereon, and all rights, ways, privileges, servitudes, advantages and appurtenances
15 thereunto belonging or in anywise appertaining, situated in the Southeast Quarter of
16 the Southwest Quarter, Section 10, Township 22 North, Range 2 East, being a
17 portion of that certain 25 acre tract of land described in Act of Sale from Perry W.
18 Bennett to Samuel M. Parker which appears of record in Book 31, at page 105, of the
19 Conveyance Records of Union Parish, Louisiana, which piece or portion of ground
20 is more particularly described as follows, to-wit:

1 Beginning at a point in the east line of the Marion-Oakland Highway on State Route
2 No. 816, which point marks the intersection of the east line of the said
3 Marion-Oakland Highway with the boundary line between the property of Samuel
4 M. Parker and the property now formerly owned by P. McVickey; run thence east
5 along said boundary line, a distance of 80.8 feet to a point; thence north 155.5 feet
6 to a point in the boundary line between the property of Samuel M. Parker and the
7 property now or formerly owned by R. L. Edwards; run thence west along said
8 boundary line, a distance of 160 feet to a point in the east right of way line of the
9 Marion-Oakland Highway; along the east right of way line of said highway, a
10 distance of 180 feet to the point of beginning, and containing 0.43 acres, all as more
11 full shown on plan of survey by W.F. Cooper dated September 16, 1941, blue print
12 of which plan is annexed hereto and made a part hereof.
13	Less and Except
14 Less and except any highway area under the control of DOTD and less and except
15 any other public streets.
16 Section 2.  The secretary of the Department of Transportation and Development is
17hereby authorized to enter into such agreements, covenants, conditions, and stipulations and
18to execute such documents as necessary to properly effectuate any conveyance, transfer,
19assignment, lease, or delivery of title, excluding mineral rights, to the property described in
20Section 1 of this Act, and as more specifically described in any such agreements entered into
21and documents executed by and between the secretary of the Department of Transportation
22and Development and the governing authority of the Town of Marion in Union Parish,
23Louisiana, in exchange of consideration proportionate to the appraised value of the property.
24 Section 3.  This Act shall become effective upon signature by the governor or, if not
25signed by the governor, upon expiration of the time for bills to become law without signature
26by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
27vetoed by the governor and subsequently approved by the legislature, this Act shall become
28effective on the day following such approval.
