ENROLLED ACT No. 61 2015 Regular Session HOUSE BILL NO. 219 BY REPRESENTATIVES BROWN AND SHADOIN AN ACT To authorize and provide for the transfer of certain state property; to authorize the transfer of certain state property in Union Parish; to provide for the property description; to provide for reservation of mineral rights; to provide terms and conditions; to provide an effective date; and to provide for related matters. Be it enacted by the Legislature of Louisiana: Section 1. The secretary of the Department of Transportation and Development, notwithstanding any other provision of law to the contrary, is hereby authorized and empowered to convey, transfer, assign, lease, or deliver any interest, excluding mineral rights, the state may have to all or any portion of the following described parcel of property to the governing authority of the Town of Marion in Union Parish, Louisiana: Legal Description A certain piece or portion of ground, together with all buildings and improvements thereon, and all rights, ways, privileges, servitudes, advantages and appurtenances thereunto belonging or in anywise appertaining, situated in the Southeast Quarter of the Southwest Quarter, Section 10, Township 22 North, Range 2 East, being a portion of that certain 25 acre tract of land described in Act of Sale from Perry W. Bennett to Samuel M. Parker which appears of record in Book 31, at page 105, of the Conveyance Records of Union Parish, Louisiana, which piece or portion of ground is more particularly described as follows, to-wit: Beginning at a point in the east line of the Marion-Oakland Highway on State Route No. 816, which point marks the intersection of the east line of the said Marion-Oakland Highway with the boundary line between the property of Samuel M. Parker and the property now formerly owned by P. McVickey; run thence east along said boundary line, a distance of 80.8 feet to a point; thence north 155.5 feet Page 1 of 2 HB NO. 219 ENROLLED to a point in the boundary line between the property of Samuel M. Parker and the property now or formerly owned by R. L. Edwards; run thence west along said boundary line, a distance of 160 feet to a point in the east right of way line of the Marion-Oakland Highway; along the east right of way line of said highway, a distance of 180 feet to the point of beginning, and containing 0.43 acres, all as more full shown on plan of survey by W.F. Cooper dated September 16, 1941, blue print of which plan is annexed hereto and made a part hereof. Less and Except Less and except any highway area under the control of DOTD and less and except any other public streets. Section 2. The secretary of the Department of Transportation and Development is hereby authorized to enter into such agreements, covenants, conditions, and stipulations and to execute such documents as necessary to properly effectuate any conveyance, transfer, assignment, lease, or delivery of title, excluding mineral rights, to the property described in Section 1 of this Act, and as more specifically described in any such agreements entered into and documents executed by and between the secretary of the Department of Transportation and Development and the governing authority of the Town of Marion in Union Parish, Louisiana, in exchange of consideration proportionate to the appraised value of the property. Section 3. This Act shall become effective upon signature by the governor or, if not signed by the governor, upon expiration of the time for bills to become law without signature by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If vetoed by the governor and subsequently approved by the legislature, this Act shall become effective on the day following such approval.
