HLS 15RS-9 ORIGINAL 2015 Regular Session HOUSE BILL NO. 228 BY REPRESENTATIVE REYNOLDS MINERALS/RIGHTS-ROYALTY: Dedicates a certain amount of mineral revenues from oil and gas production in and around Lake Bistineau to weevil production for control of giant salvinia in the lake 1 AN ACT 2To enact R.S. 56:10.2, relative to state mineral income from activity in and adjacent to Lake 3 Bistineau; to dedicate a portion of such revenue to weevil production for control of 4 giant salvinia in the lake; to create the Lake Bistineau Management Account in the 5 Conservation Fund; to provide for the use of monies in the account; to provide 6 legislative oversight; to provide for termination; to provide for an effective date; and 7 to provide for related matters. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 56:10.2 is hereby enacted to read as follows: 10 ยง10.2. Lake Bistineau Management Account; dedication of mineral activity 11 revenues 12 A. Notwithstanding any other provision of law to the contrary, after 13 allocation of monies to the Bond Security and Redemption Fund as provided in 14 Article VII, Section 9(B) of the Constitution of Louisiana, and after satisfying the 15 required allocations in Article VII, Sections 4, 10-A, and 10.2 of the Constitution of 16 Louisiana, an amount equal to three hundred thousand dollars in any one year 17 received from leases, bonuses, royalties, rights-of-way, and other sums payable to 18 the state as lessor of mineral leases and grantor of rights-of-way as required pursuant 19 to R.S. 30:136(B) and 136.1(A) and (B), on state water bottoms of Lake Bistineau, Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 15RS-9 ORIGINAL HB NO. 228 1 specifically excluding any water bottoms located in Loggy Bayou Wildlife 2 Management Area, shall be deposited by the treasurer into the Lake Bistineau 3 Management Account in the Conservation Fund, hereinafter referred to as the 4 "account", which is hereby created as a special account in the Conservation Fund. 5 The monies in the account shall be invested by the treasurer in the manner provided 6 by law, and interest earned on the investment of those monies shall be deposited in 7 and credited to the account. All unexpended or unencumbered monies remaining in 8 the account at the end of the fiscal year shall remain in the account. 9 B. The monies in the account shall be appropriated each year by the 10 legislature for use exclusively by the Department of Wildlife and Fisheries for 11 weevil production for control of giant salvinia in Lake Bistineau. Each year's plan 12 for the expenditure of monies appropriated from the account shall be subject to the 13 approval of the House Committee on Natural Resources and Environment and the 14 Senate Committee on Natural Resources. 15 C. The provisions of this Section shall terminate and become null and void 16 on and after July 1, 2017. 17 Section 2. This Act shall become effective on July 1, 2015; if vetoed by the governor 18and subsequently approved by the legislature, this Act shall become effective on July 1, 192015, or on the day following such approval by the legislature, whichever is later.
