HB 26 Engrossed	2015 Regular Session	Miller
Abstract: Provides with respect to powers of the governing authority of St. Charles Parish relative
to grass cutting.
Present law authorizes parish governing authorities to require property owners to cut grass on their
property. Authorizes the parishes to have such work done and charge the property owner for the
work if the property owner does not cut the grass himself. Requires the parish governing authority
to serve a registered or certified letter as notification to property owners each time before cutting or
removing obnoxious weeds growing on the property.
Present law authorizes the governing authorities of the parishes of Point Coupee and St. Landry to
amend local ordinances to require that only one yearly notice be sent to compel property owners to
cut grass on their property. Proposed law adds the governing authority of St. Charles to parishes so
authorized; otherwise retains present law.
Present law requires that prior to authorizing the grass cutting, the governing authorities shall file
and record an affidavit, signed by the parish president. Such affidavit shall include the following:
1. A description of the property.
2. A photograph of the property identifying the unsafe conditions.
3. A statement that the property owner liable has within the past 12 months failed to do such
work after notification and an opportunity to do so.
Proposed law retains present law and makes it applicable to St. Charles Parish.
