Louisiana House Bill HB26 Comm Sub / Analysis

                    RÉSUMÉ DIGEST
ACT 41 (HB 26) 2015 Regular Session	Miller
Existing law authorizes parish governing authorities to require property owners to cut grass
on their property. Authorizes the parishes to have such work done and charge the property
owner for the work if the property owner does not cut the grass himself. Requires the parish
governing authority to serve a registered or certified letter as notification to property owners
each time before cutting or removing obnoxious weeds growing on the property.
Existing law authorizes the governing authorities of the parishes of Point Coupee and St.
Landry to amend local ordinances to require that only one yearly notice be sent to compel
property owners to cut grass on their property. New law adds the governing authorities of
St. Charles and St. John the Baptist to parishes so authorized.
Existing law requires that prior to authorizing the grass cutting, the governing authority shall
file an affidavit that includes:
(1)A description of the property.
(2)A photograph of the property identifying the unsafe conditions.
(3)A statement that the property owner liable has within the past 12 months failed to do
such work after notification and an opportunity to do so.
New law makes existing law applicable to St. Charles Parish and St. John the Baptist Parish.
Effective August 1, 2015.
