HLS 15RS-921 ORIGINAL 2015 Regular Session HOUSE BILL NO. 285 BY REPRESENTATIVE MONTOUCET PEST CONTROL OPERATORS: Provides relative to fees established for certain structural pest control business owners 1 AN ACT 2To amend and reenact R.S. 3:3374(A) and 3375(B), relative to fees paid by structural pest 3 control business owners; to increase the fees for each standard contract and wood 4 destroying insect report submitted; to remove the Structural Pest Control 5 Commission's ability to appoint a committee to recommend research topics; and to 6 provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 3:3374(A) and 3375(B) are hereby amended and reenacted to read 9as follows: 10 §3374. Fees 11 A. Each person who holds a place of business permit shall pay the fees 12 established in this Subsection for standard contracts and wood destroying insect 13 reports. Fees shall be paid at the expense of the person who holds the place of 14 business permit and shall be paid at the time the person files the report required by 15 R.S. 3:3370(B). The fee for each standard contract reported shall be established by 16 the commission by rule at not less than five dollars and not more than eight sixteen 17 dollars. The fee for each wood destroying insect report reported shall be established 18 by the commission by rule at not less than five dollars and not more than eight 19 sixteen dollars. When the amount of the fees collected under pursuant to this Section 20 in any fiscal year equals the amount appropriated for the commission and its Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 15RS-921 ORIGINAL HB NO. 285 1 programs for that fiscal year, the commission shall allocate the fees collected for 2 standard contracts and wood destroying insect reports for the remainder of that fiscal 3 year to the Louisiana State University Experiment Station for the purpose of 4 structural pest control research. 5 * * * 6 §3375. Disposition of fees 7 * * * 8 B. Out of the monies appropriated each year to the commission, the 9 commission shall allocate at least thirty thousand dollars to the Louisiana State 10 University Experiment Station for research. The allocation shall be made at least 11 biannually. The commission shall appoint a committee composed of the 12 commissioner or his designee, the chancellor of the Louisiana State University 13 Agricultural Center or his designee, the director of the Louisiana State University 14 Experiment Station or his designee, the president of the Louisiana Structural Pest 15 Control Association, the executive director of the Louisiana Pest Control 16 Association, and three licensed pest control operators. This committee shall make 17 recommendations to the commission on what research is needed. Committee 18 members shall be appointed for one year. The commission shall determine the areas 19 in which the research shall be conducted and shall review research progress at an 20 annual meeting. At the end of each fiscal year, all unexpended funds which were 21 allocated under the provisions of this Section shall revert to the Structural Pest 22 Control Commission Fund. Proposed law removes the minimum fee of five dollars and increases the maximum fee to $16. Present law allows the commission to appoint a committee to make recommendations on what research committee members should be conducting. Proposed law removes the commission's authority to appoint a committee for the purposes of making recommendations for research.
