HOUSE BILL NO. 298

1	AN ACT
2 To amend and reenact R.S. 51:652(B) and 656(B)(2), relative to the sale of fireworks; to
3 provide for the dates and times during which fireworks may be sold; to provide with
4 respect to the issuance of retailer permits; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 51:652(B) and 656(B)(2) are hereby amended and reenacted to read
7 as follows: 
8 §652.  Proper naming; certification on shipping cases; time for selling; exceptions;
9	sale and storage in homes prohibited

11	B.  Permissible items of fireworks, enumerated in R.S. 51:651 may be sold
12 at retail from noon June twenty-fifth sixteenth through midnight July fifth and noon
13 December fifteenth through midnight January first of each year only, except that the
14 term "fireworks" shall not include toy pistols, toy canes, toy guns, or other devices
15 in which paper caps containing twenty-five hundredths (25/100) grains or less of
16 explosive compounds are used, provided they are so constructed that the hand cannot
17 come in contact with the cap when in place for exploding, and toy paper pistol caps
18 which contain less than twenty-five hundredths (25/100) grains of explosive
19 compounds, and the sale and use of which shall be permitted at all times.

1	(2)  The retail permit shall be effective for purchases of wholesale fireworks,
2 and the permit shall be effective from the date of issuance through midnight
3 December thirty-first of the applicable year. No retailer's permit shall be issued under
4 pursuant to this Part from June twenty-fifth sixteenth through July fifth nor from
5 December fifteenth through January first of each year. All other permits issued under
6 pursuant to the provisions of this Section shall be valid from the date issued through
7 midnight April first of the ensuing permit year. All applications filed after April first
8 shall be assessed a late fee equal to the amount of the permit required by this Section.
