HOUSE BILL NO. 344

1	AN ACT
2 To amend and reenact R.S. 27:427(H) and 449(B) and (C) and to enact R.S. 27:449(D),
3 relative to video draw poker employee permits; to provide with respect to the
4 issuance of video draw poker employee permits; to provide that a person who is the
5 holder of a valid video draw poker employee permit shall not be required to undergo
6 an additional suitability determination to be named a designated representative; to
7 prohibit a person who has had a video draw poker employee permit denied or
8 revoked from serving as a designated representative; to prohibit provisional
9 authorization to work for a person who has had a video draw poker employee permit
10 denied or revoked; to require a subsequent suitability determination for an employee
11 with an expired video draw poker employee permit prior to that person serving as a
12 designated representative; to establish a time period that a provisional authorization
13 to work is valid; to require that a licensee maintain a list of designated
14 representatives; and to provide for related matters.
15 Be it enacted by the Legislature of Louisiana:
16 Section 1.  R.S. 27:427(H) and 449(B) and (C) are hereby amended and reenacted
17 and R.S. 27:449(D) is hereby enacted to read as follows:
18 §427.  Suitability requirements

20	H.(1) On or after August 15, 2009, a licensee who employs a designated
21 representative Before an individual is named as a designated representative of the
22 licensee at a licensed qualified truck stop facility, Louisiana State Racing
23 Commission licensed pari-mutuel wagering facility, or an offtrack wagering facility,
24 the licensee shall do all of the following prior to employing the person both of the
25 following:

1	(a)  Obtain conviction records of an applicant seeking employment as a
2 designated representative pursuant to the provisions of R.S. 15:587(F).
3	(b)  Determine that, based upon those conviction records, the applicant meets
4 the suitability requirements provided for in Subsection A of this Section.
5	(2)  A licensee is exempt from complying with Paragraph (1) of this
6 Subsection if the person holds a valid video draw poker employee permit. If the
7 designated representative's video draw poker employee permit expires, the licensee
8 shall immediately comply with Paragraph (1) of this Subsection.
9	(3)  A person whose video draw poker employee permit is suspended or who
10 has had his permit revoked within the last five years, unless he currently holds a
11 valid video draw poker permit, is prohibited from serving as a designated
12 representative.
13	(2)(4)  The licensee shall have a continuing duty to inform the division of any
14 action taken by the designated representative which they believe would constitute a
15 violation of this Chapter.
16	(3)(5)  The licensee shall maintain the information required by the provisions
17 of this Subsection and have it readily available for inspection by the division.
18	(6)  The licensee shall maintain a list of names of the persons employed as
19 designated representatives, have the list readily available for inspection by the
20 division, and provide the list to the division upon request.  The list shall also indicate
21 whether that person holds a valid video draw poker employee permit.

23 §449.  Provisional authorization to work pending suitability determination
24	*          *          *
25	B.  The document acknowledging receipt of the application and supporting
26 documentation shall serve indicate whether it serves as a provisional authorization
27 for the applicant to work in the capacity for which the applicant is seeking the video
28 draw poker employee permit.
29	C.  No provisional authorization shall be issued to an applicant who has
30 previously had a video draw poker employee permit denied or revoked.

1	C.D.  The provisional authorization shall expire ninety days from the date of
2 issuance or when the division approves or denies the application for the issuance of
3 a video draw poker employee permit, whichever occurs first.
