INSURANCE/GROUP-STATE:  Provides relative to pharmacy benefits
1	AN ACT
2To amend and reenact R.S. 22:1011(C) and to enact R.S. 22:1011(D), relative to employer-
3 provided health plan pharmacy benefits; to prohibit the requirement that certain
4 employees  obtain prescription drugs from a mail order pharmacy as a condition of
5 payment for such drugs; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 22:1011(C) is hereby amended and reenacted and R.S. 22:1011(D)
8is hereby enacted to read as follows: 
9 ยง1011.  Employer-provided health plan; limitation to specific pharmacies prohibited;
10	penalty

12	C.  The provisions of this Section shall apply to any policies, contracts,
13 programs, or plans which are provided by the state as an employer to employees,
14 retirees, or dependents of employees or retirees by either the Office of Group
15 Benefits or any other approved plan offered to state employees or members of the
16 legislature.
17	D.  Any person violating the provisions of this Section, upon conviction shall
18 be fined not more than five hundred dollars.

Abstract:  Applies to health insurance plans offered by the Office of Group Benefits the
prohibition on requiring employees or retirees to obtain prescription drugs from a
mail order pharmacy as a condition of receiving payment for such drugs, or imposing
a copayment fee not imposed upon employees or retirees who utilize the designated
mail order pharmacy.
Present law prohibits employers providing pharmacy services in an employer-provided
health plan from requiring employees or retirees to obtain prescription drugs from a mail
order pharmacy as a condition of receiving payment for such drugs, or from imposing a
copayment fee or other condition not imposed upon employees or retirees who utilize the
designated mail order pharmacy.
Proposed law retains present law and applies it to health plans provided to state employees
by the Office of Group Benefits or any other approved plans offered to state employees or
members of the legislature.
