HEALTH CARE/PROVIDERS:  Exempts certain providers from licensure as behavioral
health services providers
1	AN ACT
2To enact R.S. 40:2154(18), relative to behavioral health services rendered to specialty
3 courts; to exempt from licensure requirements providers furnishing behavioral health
4 services to certain specialty courts; to provide for an effective date; and to provide
5 for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 40:2154(18) is hereby enacted to read as follows: 
8 ยง2154.  Applicability
9	The provisions of this Part shall not apply to the licensing of any of the
10 following facilities or persons and shall not be construed as requiring any of the
11 following facilities or persons to seek licensure as a behavioral health services
12 provider:

14	(18)  Facilities or services operated for the sole purpose of providing
15 substance abuse or  mental health services to courts that are recognized and certified
16 by the Louisiana Supreme Court as specialty courts.
17 Section 2.  This Act shall become effective upon signature by the governor or, if not
18signed by the governor, upon expiration of the time for bills to become law without signature
19by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If

1vetoed by the governor and subsequently approved by the legislature, this Act shall become
2effective on the day following such approval.

Abstract:  Establishes an exemption to the behavioral health services provider licensure
requirement for providers operating for the sole purpose of furnishing substance
abuse or mental health treatment services to specialty courts certified by the La.
Supreme Court.
Present law requires behavioral health services providers to be licensed by the Dept. of
Health and Hospitals.
Proposed law retains present law but adds an exemption for providers operating for the sole
purpose of furnishing substance abuse or mental health services to courts certified by the La.
Supreme Court as specialty courts.
Effective upon signature of governor or lapse of time for gubernatorial action.
