SCHOOLS/FOOD PROGRAMS:  Requires the State Board of Elementary and Secondary
Education to promulgate rules relative to requirements for student lunch time
1	AN ACT
2To enact R.S. 17:7(33), relative to the State Board of Elementary and Secondary Education;
3 to provide with respect to powers, duties, and responsibilities of the board; to require
4 the board to promulgate rules pertaining to student lunch time; and to provide for
5 related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:7(33) is hereby enacted to read as follows: 
8 ยง7.  Duties, functions, and responsibilities of board
9	In addition to the authorities granted by R.S. 17:6 and any powers, duties, and
10 responsibilities vested by any other applicable laws, the board shall:

12	(33)  Promulgate a rule in accordance with the Administrative Procedure Act
13 to require the governing authority of each public school to provide no less than
14 twenty minutes for students to be seated and consume their food at lunch time.  The
15 twenty minutes of seated lunch time shall be separate from the time required for
16 students to navigate from the classroom to the lunch room, stand in line to receive
17 the lunch meal, and return to the classroom after lunch has been consumed.
18 Section 2.  The State Board of Elementary and Secondary Education shall promulgate
19the rule required by this Act prior to the start of the 2015-2016 school year and the rule shall
20be applicable to that school year and thereafter.

1 Section 3.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Abstract:  Requires the State Board of Elementary and Secondary Education to promulgate
rules pertaining to student lunch time. 
Present law provides with respect to the State Board of Elementary and Secondary Education
(BESE).  Provides relative to the powers, duties, and responsibilities of the board.
Proposed law requires the board to promulgate a rule in accordance with present law (the
Administrative Procedure Act) to require the governing authority of each public school to
provide no less than 20 minutes of seated lunch time.
Effective upon signature of governor or lapse of time for gubernatorial action.
