HLS 15RS-630 ENGROSSED 2015 Regular Session HOUSE BILL NO. 414 BY REPRESENTATIVE REYNOLDS DISTRICTS/DOWNTOWN DEVEL: Provides relative to the Downtown Development District of the city of Minden 1 AN ACT 2To amend and reenact R.S. 33:2740.24(C)(1) and (2), (D), and (E), relative to the 3 Downtown Development District of the city of Minden; to provide with respect to 4 the membership of the governing commission of the district; to provide relative to 5 governance of the district, including the power of the mayor of Minden with respect 6 to the activities of the district; and to provide for related matters. 7 Notice of intention to introduce this Act has been published 8 as provided by Article III, Section 13 of the Constitution of 9 Louisiana. 10Be it enacted by the Legislature of Louisiana: 11 Section 1. R.S. 33:2740.24(C)(1) and (2), (D), and (E) are hereby amended and 12reenacted to read as follows: 13 ยง2740.24. Minden Downtown Development District; commission; powers 14 * * * 15 C.(1) The district shall be governed by a commission, which is hereby 16 designated as the Downtown Development District Commission. The commission 17 shall be composed of seven members, all of whom shall be qualified voters of the 18 city of Minden, and shall have their principal place of business or profession in, or 19 own property in, the Downtown Development District or hold a majority interest in 20 a business or property located in the district. HLS 15RS-630 ENGROSSED HB NO. 414 1 by the mayor of the city of Minden with upon the approval of the city council as 2 follows: with due consideration being given to the needs and desires of the 3 commission. The commission shall appoint subcommittees, for various needs and 4 events, with no limitations on residency. 5 (a) Two members shall be appointed from a list of nominees submitted by 6 the Minden Chamber of Commerce. 7 (b) Two members shall be appointed from a list of nominees submitted by 8 the Retail Merchants Association of the city of Minden. 9 (c) Two members shall be appointed from a list of nominees submitted by 10 the Minden Historic District Commission. 11 (d) One member shall be appointed from a list of nominees submitted by the 12 Minden NAACP. 13 (2) In addition, the mayor of the city of Minden and the project manager 14 director shall be nonvoting ex officio members of the commission. 15 * * * 16 D. The commission shall elect a chairman, vice chairman, and a 17 secretary-treasurer from among its members. The terms of the officers shall be one 18 year, but any officer shall be eligible for reelection. The commission shall adopt 19 such rules for the transaction of its business as it deems necessary and shall keep a 20 record of its resolutions, transactions, studies, findings, and determinations, which 21 record shall be public record. The mayor's office shall be provided with a copy of 22 all such transactions and records. 23 E. The commission mayor, with council approval, shall be empowered to 24 employ a manager director and such other employees as are necessary to carry out 25 the functions of the commission. It shall be the function and duty of the commission 26 and director to formulate the program to implement the various development plans 27 of Minden Main Street Project heretofore or hereafter submitted, upon approval of 28 the mayor of the city of Minden, and it shall revise or amend its decisions from time 29 to time as it sees fit with the approval of the mayor of the city of Minden. HLS 15RS-630 ENGROSSED HB NO. 414 1 program shall implement the various plans with the responsibility of aiding and 2 encouraging private development. A copy of such plans shall be submitted to the 3 mayor's office by the director for review and approval. In carrying out such 4 programs, the commission may consult with all departments of the city of Minden 5 and such other public agencies as are concerned with matters affecting or affected 6 by the program. The commission may conduct studies and based thereon may make 7 such recommendations as it determines are calculated to implement the intent and 8 purposes of this Section. The Downtown Development District manager director 9 shall also serve and function as the manager of the Minden Main Street Project. 10 * * * 11 Section 2. The terms of the members of the governing commission of the Downtown 12Development District of the city of Minden in office on the effective date of this Act shall 13terminate on the effective date of this Act. The successors of such members shall be 14appointed for initial terms as provided in R.S. 33:2740.24(C)(3)(a) and otherwise serve as 15provided by R.S. 33:2740.24 as amended by this Act. Proposed law removes requirement that members have their principal place of business or profession in, or own property in, the district. Also adds requirement that members hold a majority interest in a business or property located in the district if they are not qualified voters of the city of Minden. Present law provides that the seven members are appointed by the mayor of the city of Minden with the approval of the city council. Proposed law adds provision that requires the city council to give due consideration to the needs and desires of the commission during the approval process. Also adds requirement that the commission appoint subcommittees, for various needs and events, with no limitations on residency. Present law authorizes the commission to employ a manager and such other employees as are necessary to carry out the functions of the commission. Proposed law authorizes the mayor, with council approval, rather than the commission, to employ a director and such other employees. Present law requires the commission to formulate the program to implement development plans of Minden Main Street Project. Proposed law requires that the mayor receive a copy of all plans for his review and approval. Proposed law provides for termination of terms of members of the commission serving on the effective date of proposed law and appointment of members in accordance with present law and proposed law.
