ENROLLED ACT No. 333 2015 Regular Session HOUSE BILL NO. 414 BY REPRESENTATIVE REYNOLDS 1 AN ACT 2 To amend and reenact R.S. 33:2740.24(C)(1) and (2), (D), and (E), relative to the 3 Downtown Development District of the city of Minden; to provide with respect to 4 the membership of the governing commission of the district; to provide relative to 5 governance of the district, including the power of the mayor of Minden with respect 6 to the activities of the district; and to provide for related matters. 7 Notice of intention to introduce this Act has been published 8 as provided by Article III, Section 13 of the Constitution of 9 Louisiana. 10 Be it enacted by the Legislature of Louisiana: 11 Section 1. R.S. 33:2740.24(C)(1) and (2), (D), and (E) are hereby amended and 12 reenacted to read as follows: 13 ยง2740.24. Minden Downtown Development District; commission; powers 14 * * * 15 C.(1) The district shall be governed by a commission, which is hereby 16 designated as the Downtown Development District Commission. The commission 17 shall be composed of seven members, all of whom shall be qualified voters of the 18 city of Minden, and shall have their principal place of business or profession in, or 19 own property in, the Downtown Development District or hold a majority interest in 20 a business or property located in the district. The seven members shall be appointed 21 by the mayor of the city of Minden with upon the approval of the city council as 22 follows: with due consideration being given to the needs and desires of the 23 commission. The commission shall appoint subcommittees, for various needs and 24 events, with no limitations on residency. HB NO. 414 ENROLLED 1 (a) Two members shall be appointed from a list of nominees submitted by 2 the Minden Chamber of Commerce. 3 (b) Two members shall be appointed from a list of nominees submitted by 4 the Retail Merchants Association of the city of Minden. 5 (c) Two members shall be appointed from a list of nominees submitted by 6 the Minden Historic District Commission. 7 (d) One member shall be appointed from a list of nominees submitted by the 8 Minden NAACP. 9 (2) In addition, the mayor of the city of Minden and the project manager 10 director shall be nonvoting ex officio members of the commission. 11 * * * 12 D. The commission shall elect a chairman, vice chairman, and a 13 secretary-treasurer from among its members. The terms of the officers shall be one 14 year, but any officer shall be eligible for reelection. The commission shall adopt 15 such rules for the transaction of its business as it deems necessary and shall keep a 16 record of its resolutions, transactions, studies, findings, and determinations, which 17 record shall be public record. The mayor's office shall be provided with a copy of 18 all such transactions and records. 19 E. The commission mayor, with council approval, shall be empowered to 20 employ a manager director and such other employees as are necessary to carry out 21 the functions of the commission. It shall be the function and duty of the commission 22 and director to formulate the program to implement the various development plans 23 of the Minden Main Street Project heretofore or hereafter submitted, upon approval 24 of the mayor of the city of Minden, and it the commission shall revise or amend its 25 decisions from time to time as it sees fit with the approval of the mayor of the city 26 of Minden. Such a program shall implement the various plans with the responsibility 27 of aiding and encouraging private development. A copy of such plans shall be 28 submitted to the mayor's office by the director for review and approval. In carrying 29 out such programs, the commission may consult with all departments of the city of 30 Minden and such other public agencies as are concerned with matters affecting or Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. The commission may conduct studies and based thereon 2 may make such recommendations as it determines are calculated to implement the 3 intent and purposes of this Section. The Downtown Development District manager 4 director shall also serve and function as the manager of the Minden Main Street 5 Project. 6 * * * 7 Section 2. The terms of the members of the governing commission of the Downtown 8 Development District of the city of Minden in office on the effective date of this Act shall 9 terminate on the effective date of this Act. The successors of such members shall be 10 appointed for initial terms as provided in R.S. 33:2740.24(C)(3)(a) and otherwise serve as 11 provided by R.S. 33:2740.24 as amended by this Act.
